1. Who we are and these terms

This website, alithos.co, is operated by Dan Ellyson, doing business as Alithos Advisory, in California ("Alithos," "we," "us"). These Terms of Use apply to your use of the website and its tools. By using the site, or by submitting a form that links to these terms, you agree to them. If you don't agree, please don't use the site. Our Privacy Policy explains how we handle your information.

2. Information only — not a quote, not advice

Everything on this site, including the cost estimator, cost benchmarks, articles, checklists, and other tools, is general information for planning purposes. It is not a quote, bid, appraisal, or promise of what your project will cost, and it is not legal, tax, accounting, lending, investment, real estate, architectural, engineering, or construction advice. Estimates rely on assumptions and industry ranges that may not match your project, market, or timing, and actual costs, rates, and loan terms vary.

Alithos Advisory is not a law firm, CPA firm, licensed contractor, architect, engineer, real estate broker, lender, or investment adviser. Before you sign a lease, loan, purchase, or construction contract, consult the appropriate licensed professionals.

3. Paid services

Prices on this site describe our standard offerings. Paid work begins only under a written proposal and a signed engagement agreement. Accepting a proposal online shows that you intend to proceed; the engagement agreement that follows sets the binding scope, fees, and terms. If anything on this site conflicts with a signed engagement agreement, the engagement agreement controls. Project Navigator availability depends on your project's state and is confirmed before engagement.

We don't promise any particular result, such as a loan approval, a specific cost, savings, or an opening date. Lenders, landlords, contractors, and vendors make their own decisions.

4. What you send us

Please give accurate information in forms, and only information you have the right to share. By submitting a form, you agree that Alithos Advisory may contact you by email or phone about your inquiry or project. You can ask us to stop at any time.

5. Ideas and feedback

If you send us ideas, feature requests, votes, suggestions, or other feedback (for example, through the app's "Shape the app" form), you give them freely. You won't be paid for them, they aren't confidential, and Alithos may use, change, and build on them for any purpose without obligation to you. Please don't send anything you consider confidential or proprietary through those forms.

6. Our content

The site's text, graphics, logos, video, estimator, and other content belong to Alithos Advisory or its licensors and are protected by copyright and trademark law. You may view and share pages for your own use, and you may quote short excerpts with credit and a link back. Please don't copy, republish, or sell substantial parts of the site, or present our tools or content as your own, without written permission.

7. Acceptable use

Don't use the site to break the law, submit false or spam submissions, interfere with the site's operation or security, try to access accounts or areas you aren't authorized to use, or impersonate anyone.

8. Other websites and services

The site links to and uses third-party services, such as Cal.com for scheduling. We aren't responsible for their content or practices, and their own terms and privacy policies apply when you use them.

9. Disclaimer

The site and its content are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. We work to keep the information current, but costs and rules change, and we don't promise the site will be error-free or always available.

10. Limitation of liability

To the fullest extent the law allows, Alithos Advisory and Dan Ellyson won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, savings, or data, arising from your use of the site or its tools, or from decisions you make based on them. Our total liability for any claim arising from your use of the site is limited to one hundred dollars ($100). Liability for paid services is governed by your engagement agreement. Nothing in these terms limits liability that can't be limited under California law, such as liability for fraud, willful injury, or gross negligence.

11. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising from these terms or your use of the site will be brought in the state or federal courts located in the California county where Alithos Advisory's principal office is located, and you and we consent to those courts' jurisdiction.

12. Changes

We may update these terms from time to time. When we do, we'll post the new version here and update the effective date. Continued use of the site after a change means you accept the updated terms.
